OFFICIAL CONTEST RULES AND REGULATIONS
Win Your Dream Bathroom Contest (the “Contest”)
CONTEST DURATION
The Contest starts on Thursday, October 15, 2009 at 12:01 PM ET and ends on Monday, November 30, 2009 at 11:59 PM ET (the “Contest Period”).
PRIZES
GRAND PRIZES:
There is one (1) Grand Prize available in this Contest, consisting of one (1) complete bathroom renovation, redesigned and completely rebuilt by Cecconi Simone and American Standard Brands (the Contest “Sponsors”), including premium fixtures, furniture, contract labour, tile, mirrors and lighting, up to a maximum value of $30,000.00 CAD. The bathroom design will be created in consultation with the Grand Prize winner, however, all decisions related to the Grand Prize renovation including design choices, selection of materials, choice of contract labour and all design, renovation, contract and Grand Prize-related decisions will be at the sole discretion of the “Sponsors”. Approximate retail value of the Grand Prize is $30,000.00 CAD.
Grand Prize renovation costs will include construction, labour, materials and supplies, but may not include structural changes, replacement of existing wiring and/or plumbing. Grand Prize renovation costs may only exceed the $30,000.00 CAD budget where the Grand Prize winner agrees to be the sole bearer of those costs and where any added labour remains within the $30,000.00 CAD budget. The Grand Prize renovation will be performed on a privately-owned home only, which must be owned by the Grand Prize winner. The Grand Prize renovation will be performed in an existing bathroom only and rooms which are not bathrooms will not be considered for the Grand Prize renovation. Travel costs and other expenses incurred as a direct result of the Grand Prize renovation may be included in the $30,000.00 CAD budget at the sole discretion of the Sponsors. The Grand Prize winner must agree to permit the Sponsors to decorate and photograph and/or videotape their home for Contest-related publicity.
SECOND PRIZES:
There are two (2) Second Prizes available in this Contest, each consisting of powder room furniture and fixtures up to a maximum value of $2,000.00 CAD. Approximate retail value of each Second Prize is $2,000.00 CAD.
THIRD PRIZES:
There are seven (7) Third Prizes available in this Contest, each consisting of the Third Prize winner’s choice of one (1) American Standard faucet available in Canada at the time of this Contest, up to a maximum value of $350.00 CAD. Approximate retail value of each Third Prize is $350.00 CAD.
All incremental costs in using or claiming a Prize not outlined in the Prize descriptions are the sole responsibility of the Prize Winners.
The Prizes in this Contest must be accepted as described in these Official Contest Rules and Regulations and cannot be transferred, assigned, changed, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these Official Contest Rules and Regulations. Any Prize refused or not accepted by a declared Prize winner will result in that Prize winner being declared ineligible to win a Prize in this Contest
Odds of winning a Prize in this Contest depend upon the quality and the number of eligible entries received.
HOW TO PARTICIPATE
There are two (2) ways to participate in this Contest:
1. PHOTO SUBMISSION. You may enter the Contest by visiting the Win Your Dream Bathroom Contest web site at www.americanstandard.ca. Upload your photos (minimum of one (1) photo to a maximum of (4) four photos with a file size no greater than two (2) megabytes each), and in no more than one hundred (100) words tell us what’s not working for you about your bathroom and what you think it needs to improve, fully complete the entry form, confirm compliance with the Contest rules and click “enter” and you will be automatically entered into the Contest.
2. VIDEO SUBMISSION. You may enter the Contest by visiting the Win Your Dream Bathroom Contest web site at www.americanstandard.ca. Create a narrated video (to a maximum length of one (1) minute), publish it to YouTube or third party video-sharing web site (such as Vimeo, Google Video or other video-sharing web site service that permits viewing without user registration), show us your bathroom and tell us what’s not working for your about your bathroom and what you think it needs to improve, fully complete the entry form, paste the link to your video, confirm compliance with the Contest rules and click “enter” and you will be automatically entered into the Contest.
The Sponsors are not responsible for technical problems with digital photos, uploading photos or viewing videos posted on YouTube or other video-sharing web sites. If the Sponsors cannot view the bathroom with the photos or video link submitted, the submitted video is longer than one minute, the written bathroom story is longer than 100 words, or any submitted photos or videos do not satisfy the Contest requirements, such entry will be disqualified. For video entries, the Sponsors recommend that each entrant test their video link before submitting it with an entry.
Limit one (1) entry per person per household during the Contest Period. If the Sponsors find that more than one entry is received from the same person, from the same email address or features the same bathroom, all associated entries will be disqualified.
No responsibility is assumed by the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, as well as lost, misdirected, illegible or late entries which for any reason are not received.
ELIGIBILITY
This Contest is open only to home-owning legal residents of Canada over the age of majority in their province of residence and who are residing in Canada during the Contest Period. To be eligible to participate in this Contest, each entrant must own his or her own home. Any entry from an entrant whose home contains any knob-and-tube wiring or who operates a business in their home will be declared ineligible.
You are not eligible if you are an employee, representative or agent of the Sponsors, or any of Sponsors’ affiliates, subsidiaries, parent or related companies, advertising or promotional agencies or a member of the immediate family or household of any of the above persons. You are not eligible if you are a professional interior designer, decorator, architect or an employee, representative or agent of professional interior designer, decorator, architectural organizations.
The Sponsors assume no responsibility for lost, late, stolen, misdirected, mutilated, incomplete or illegible entries, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsors assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
Entries will be accepted during the Contest Period only.
SELECTION PROCESS
SEMI-FINALISTS
Starting December 7, 2009 in Toronto, Ontario, twenty-five (25) entries will be selected as the Semi-Finalists by the Contest Judging Committee from all eligible entries received, based on the following equally-weighted criteria:

Cecconi Simone will then select ten (10) Finalists from the selected Semi-Finalists, based on the following equally-weighted criteria:
FIRST, SECOND AND THIRD PLACE SELECTION
The ten (10) Finalists’ entries as selected by Cecconi Simone will be published on the Contest site at www.americanstandard.ca and the public will be invited to vote to determine the First, Second and Third place entries. Voters will be required to vote based on the following equally-weighted criteria:
Limit of one (1) vote per person during the voting period only. The Sponsors reserve the right to disqualify any votes that it finds to be in violation of these Official Contest Rules and Regulations or tampering with the Contest process. Votes generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified, along with the associated Finalist entry. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsors reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
The Finalist entry receiving the greatest number of votes will be selected as the potential Grand Prize winner, the next two (2) entries with the next greatest numbers of votes will become potential Second Prize winners, and the remaining seven (7) Finalist entries selected as the potential Third Prize winners. Should any potential Prize winner be unable to be declared as a winner in this Contest according to the Contest rules, the entry with the next largest number of votes will take their place in the Prize structure and any eligible Semi-Finalist entries will take their place, based on highest original judges’ scores, in the Prize structure until all Prizes in this Contest are awarded.
WINNER NOTIFICATION
The selected entrants will be contacted by telephone, mail or e-mail. In the event a selected entrant cannot be contacted within five (5) days of the selection date, another entrant will be selected in accordance with these rules.
In order to be declared the winner of a Prize, a selected entrant must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time limited mathematical skill-testing question to be administered at a mutually convenient time over the telephone. There will be only one opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win a Prize in this Contest. The procedure outlined above will be followed until the Prizes in this Contest have been awarded.
The selected entrant will have five (5) days to return their Release & Indemnity Form to the independent contest administrator. If the selected entrant does not return their Release & Indemnity Form within five (5) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these Official Contest Rules and Regulations.
ENTRIES
All entries become the property of the Sponsors and none shall be returned. By entering this Contest, entrants indicate their consent to their personal information being stored, used and processed for purposes concerning this Contest by the Sponsors. The declared Prize Winners’ information including his/her name, mailing address, telephone number and/or e-mail address, will be shared with the Sponsors and the independent contest administrator, as required to award the Prizes in this Contest.
RIGHTS RESERVED
The Prizes available in this Contest must be accepted as awarded and are not transferable and no substitutions will be made, whether in cash or otherwise, except at the Sponsors’ sole discretion. The Sponsors reserve the right to substitute a Prize of equivalent or greater value in the event that, for reasons beyond its control, the Sponsors are unable to award a Prize as described in these rules.
In the event that the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, including any network server or hardware failure, errors in programming, printing, distribution or production errors or any other errors or other causes of any nature whatsoever beyond the reasonable control of the Sponsors and/or their agencies which corrupt or affect the administration, security, integrity or proper conduct of this Contest, the Sponsors reserve the right to terminate or suspend the Contest, in whole or in part, or modify it in any way, at the Sponsors’ sole discretion, without advance notice, subject to the approval of the the Régie des alcools, des courses et des jeux.
The Sponsors reserve the right to disqualify any individual that it finds to be in violation of these Official Contest Rules and Regulations or tampering with the Contest process. The Sponsors reserve the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsors reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
GENERAL
By participating in this Contest, entrants agree to comply with these Official Contest Rules and Regulations and with the decisions of the Sponsors, judges and/or the independent contest administrator, which are irrevocable and shall be legally binding in all instances.
By participating in this Contest, the Prize Winners agree to sign a Declaration and Release Form in the manner prescribed herein, releasing the Sponsors, their affiliates, respective advertising and promotional agencies, and the independent contest administrator from any liability in connection with this Contest or the Prizes awarded.
By participating in this Contest, all entrants and Prize Winners agree to the use of their submitted entry information including bathroom story, name, address (city and province only), photo, and/or image on videotape for publicity purposes relating exclusively to this Contest without compensation.
By participating in this Contest, all entrants grant to the Sponsors a worldwide, non-exclusive, unrestricted, royalty-free, perpetual, irrevocable, assignable right and license to use, reproduce, modify, publish, create derivative works from, translate, license, publicly perform and display the submitted entry information, images or video (in whole or in part) and/or to incorporate it in other works in any form, media or technology now known or later developed, without your prior approval, and all entrants further waive any copyright that they may have in the submitted entry information. In addition, by submitting an entry in this Contest, each entrant represents and warrants that they own and control all rights in and to the submitted entry information and that each entrant has the right to grant the foregoing rights to the Sponsors.
By accepting a Prize in this Contest, the Prize Winners release the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize.
In the event of a dispute regarding the identity of the person entering the Contest electronically, the entry will be deemed to be submitted by the "authorized account holder" in whose name the e-mail account is registered, provided that person meets all eligibility criteria of this Contest. "Authorized account holder" shall mean the natural person assigned to an e-mail address and/or telephone number, by an Internet service provider, on-line service provider, telephone service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
This Contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
